Sydney Harbour Hotel Terms & Conditions

The terms and conditions outlined below apply when booking directly with Sydney Harbour Hotel (GAG Sydney Harbour Business Co Pty Ltd ACN 661 716 114). If you purchase any product or service through this Site, you agree to be bound by these Conditions of Sale.

Please read these terms and conditions carefully.

All bookings made are subject to these terms and conditions and by making a booking and/or payment you are accepting these Terms and Conditions on behalf of yourself and all persons who will be staying in the accommodation.

Bookings may be subject to additional terms and conditions which are specific to unique packages. Every now and then, a variation to these may be applicable to special packages or offers booked. These terms and conditions may relate to items such as payments, deposits and cancellations and you should confirm the exact conditions before booking. 

Once you have made your booking, make sure to check the Room or Package inclusions on your Booking Confirmation email to be certain of the specific details that apply to your unique booking.

Sydney Harbour Hotel reserves the right to modify or supplement at any time all or part of these Terms and Conditions. In this case a new version of the Terms and Conditions will be available on the site with the effective date. Guests are advised to regularly consult the Terms and Conditions to be aware of any changes.

Important: In the event of any discrepancy between booking conditions listed on any other page of the Sydney Harbour Hotel website or booking engine, and these Booking Conditions, the terms of these Terms and Conditions will apply.

Rates & Payments

Rates quoted are based on the room type, time of year, number of occupants and length of stay. Any alterations to these details may affect the nightly rate charged.

GST

GST applies to the purchase of goods and services from this Site and will be charged at the time of purchase.

Credit Cards

A valid credit card is required for online bookings on this Site and will also be requested from the occupant of the room when checking in. Payment via third party credit cards may be arranged by contacting the Hotel directly. Please note that guests are required to pay the confirmed charges for their reservation in full at the time of check-in at the Hotel. Advance purchase or prepaid rates will be charged at the time of booking, as marked on the rate description.

For guests without a credit card, photo ID will be requested and full cash payment of the confirmed charges for their reservation in full, plus a bond for ancillary costs, will be required at check-in. Bonds vary by room rate and length of stay.

By agreeing to these Terms and Conditions you acknowledge that unless we come to an alternative arrangement with you or the named guest, then the credit card provided will be used for payment of all accommodation and ancillary costs charged to the room, and for any damage to the room during the stay.

Payments by Credit Card will incur a transaction fee. Current fees and the accepted list of Credit Cards is 1.3% at the time of booking and is also outlined in your booking confirmation email.

Payments by Cash or EFTPOS do not incur transaction fees. Guests may elect to change method of payment to Cash or EFTPOS to avoid these fees.

Security Deposits

You must provide a credit card for pre-authorisation when you check-in.

This authorisation may be used to cover incidental items including but not limited to telephone charges, security bond or deposit for any breakages or damage incurred during your stay or cleaning charges in excess of the normal level of cleaning.

The pre-authorisation process validates your credit card and protects both the cardholder and merchant from increasing fraud incidents. 

The pre-authorised amount is set aside by the card issuer for a period of time determined by the card issuer from the date of pre-authorisation and the pre-authorisation will affect your available funds balance or spending limit. For more information on this practice please contact your card issuer.

Once a pre-authorisation has been made, Sydney Harbour Hotel may increase the pre-authorisation amount to cover extensions of stay or additional incidental charges but cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction imposed by the card issuer and cannot be negotiated. Pre-authorisation does not limit Sydney Harbour Hotel charging your credit for charges incurred that exceed the pre-authorisation amount.

Where a credit card is not available, a minimum $200.00 cash deposit, in addition to the prepayment of accommodation charge, will be required on check-in. (The actual amount required may be higher depending on the room type booked, rate and time of year).

Cancellation

If you have booked online via our website and have not yet reached your cancellation deadline, you may cancel by calling our Reservations team on +61 2 9255 1800 during business hours.  

You may generally cancel your reservation up to 2pm one day prior to arrival with no cancellation fee. After 2pm one day prior to the day of arrival, a cancellation fee of the first night’s package price will be charged.

Additional terms and conditions may apply for cancellation of advance purchase or prepaid individual rooms, group and conference & event bookings and are subject to special event block out dates.

If you have booked through a travel agent or Online Travel Agent, please contact them directly to make changes to your booking.

Reservation Status

We reserve the right to amend your booking in the event of a computer, website or system error which results in the display or communication of an incorrect room rate or other incorrect details relating to your booking. We will advise you as soon as possible in the event of such an error.

Re-Sale & Prizes

Products or services obtained from this Site (including vouchers and gift cards) may not be re-sold, on-supplied or transferred for commercial, consumer or promotional purposes, bundled with other goods and services or used for promotional purposes without the Company’s prior written consent.

Sydney Harbour Hotel room nights can be purchased for the purpose of third-party promotions and prizing with the approval of the hotel. Please email marketing@sydneyharbourhotel.com to discuss.

Sydney Harbour Hotel minimum age requirement
All persons under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian who has parental rights and responsibilities for the under 18-year-old person. If a person is found to be under the age of 18 and is not accompanied by a responsible adult, Sydney Harbour Hotel may cancel the person’s booking and ask them to leave immediately, with the full booking amount being forfeited to Sydney Harbour Hotel under this condition.

Booking direct or via a third-party
You can book directly with Sydney Harbour Hotel ACN 661 716 114 (GAG Sydney Harbour Business Company Pty Ltd), via our websites or directly with our Reservations Team, or you can book with a third-party travel agent like Flight Centre, Booking.com, Expedia etc. These are the Terms & Conditions that apply to Sydney Harbour Hotel. If you have booked via a third-party, you must check their terms and conditions for specific inclusions and conditions relating to your booking.

Travel Insurance
We recommend purchasing travel insurance to cover cancellations, travel delays and other unforeseen incidents and accidents. We encourage you to read the insurance terms and conditions to ensure you’re covered for your planned travel.

Hotel

This Site may contain Hotel information such as Hotel facilities and food and beverage outlets (Hotel Information) which the Company understands is correct at the time of posting however is subject to change. Sydney Harbour Hotel will use its reasonable efforts to keep the details of Hotel Information accurate.

No Smoking Policy
All rooms and common areas at Sydney Harbour Hotel, including the outdoor areas and roof top are non-smoking, this includes the use of electronic cigarettes and vapes.

Check-in / Check-out
Check-in is 2.00pm. Check-out is 11.00am.
We recommend you pack a change of clothes, book, sunscreen and sunglasses in your hand luggage so that you can enjoy all that Sydney has to offer while you wait for your room to be ready.

Supply of Alcohol

Certain Hotels are licensed to serve alcoholic beverages. The Company supports the responsible service of alcohol. The Company reserves the right to check the identification of any customer who wishes to purchase alcoholic beverages at the Hotels.

Pool and Rooftop

Sydney Harbour Hotel has a roof top pool, spa and deck area. This is an unmonitored area therefore use of this space is strictly at the risk of the guest. Adherence to hotel guidelines and safety protocols must be followed.

Privacy Policy
At various times Sydney Harbour Hotel may collect personal information about you and or persons accompanying you during your stay at Sydney Harbour Hotel. Use of Information 

You consent and authorise Sydney Harbour Hotel to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.

You consent to information which you have provided to Sydney Harbour Hotel as part of your booking being used by Sydney Harbour Hotel and any of their related bodies corporate for the purpose of informing you about offers and promotions which relate Sydney Harbour Hotel or related companies.

Sydney Harbour Hotel will not provide or disclose any information you have provided to Sydney Harbour Hotel to any person other than a related body corporate without your prior written consent.

Upon request by you and to the extent permitted or required by law, Sydney Harbour Hotel will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.

Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided.

Destination shots may have been supplied to Sydney Harbour Hotel by third parties and Sydney Harbour Hotel does not guarantee the accuracy of any destination shots.

Photos and floor plans are indicative only. Actual rooms occupied may vary in decor and inclusions from those shown.

Promotional Misprints
Sydney Harbour Hotel endeavours to ensure that all prices listed on their website are accurate and up-to-date. If we discover an error in the price of any offer you have booked, we will inform you as soon as possible and give you the option of cancelling it or reconfirming the booking at the correct price (in the case of a price error). If we are unable to contact you, the booking will be treated as cancelled and if you have already paid you will receive a full refund.

Intellectual Property Rights

As between you and Sydney Harbour Hotel, you agree that all intellectual property rights (including trademarks, logos, brands, graphics, images, text, software, computer programs, film clips, videos and other media) displayed on or relating to this Site and Company are owned by Sydney Harbour Hotel (or its licensors, sponsors, suppliers or related bodies corporate). Apart from the personal, non-commercial use of the content of this Site, you must not do any of the following unless you have received the prior written permission of the Company:

  • reproduce, reformat, reuse, transmit (including broadcast), communicate, adapt, distribute, sell, modify, store in a retrieval system or publish or otherwise use any of the material on this Site (including without limitation any underlying source code or other data);
  • interfere with, or attempt to interfere with, the proper working of this Site, (including, for example, by making excessive traffic demands on this website); or
  • reproduce the Company’s trademarks or logos on another website.

General

In using this Site, you must not:

  • Disrupt the operation or security of this Site or any accounts, servers, or networks connected or accessible through this Site;
  • Use this Site in a way that may harass, annoy or disrupt any third person, including a third person who may receive messages as a result of your use of this Site;
  • Submit any unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane or indecent information or material of any kind, including without limitation any material constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise breaches any applicable law;
  • Submit any material of any kind which infringes the rights of any other person, including material which is an invasion of any privacy rights, which is protected by copyright, trade mark or any other intellectual property right without first obtaining the permission of the owner or relevant right holder;
  • Submit any material of any kind which contains a virus or other harmful component;
  • Delete any author attribution, legal notices, or proprietary designations or labels in any material that is submitted;
  • Modify or delete any content on this Site or add any content to this Site;
  • Attempt to gain unauthorised access to any part of this Site; or
  • Use any robot, spider, other automatic device, or manual process to monitor, scrape, or copy any material on this Site without the prior express consent from an authorised Company representative (however such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to our Site).

Sydney Harbour Hotel reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any materials which breach any applicable or relevant law.

Release, indemnity and proportionate liability

To the extent permitted by the law, you agree to release, indemnify and hold harmless, Sydney Harbour Hotel and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at Sydney Harbour Hotel except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgement or loss arose out of, was caused by, attributable to or resulted from Sydney Harbour Hotel’s negligence, wrongful act/omission or breach of these terms and conditions.

To the extent permitted by law the aggregate of Sydney Harbour Hotel’s liability to you is limited to an amount not exceeding the amount paid by you for your booking.

Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.

Consumer Law 

To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Sydney Harbour Hotel are excluded under these Terms and Conditions.

Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits Sydney Harbour Hotel to limit its liability, then Sydney Harbour Hotel’s liability is limited to: 

  • In the case of services, supplying the services again or payment of the cost of having the services supplied again; and
  • In the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

Events Beyond Our Control 

Sydney Harbour Hotel is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.

All travel documents, observance of laws and government regulations are your responsibility.

Governing Law

The Terms of Use are governed by the laws of New South Wales, Australia and you submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

The Company may amend these Terms of Use including the Conditions of Sale from time to time and you agree to be bound by that variation from when it appears on this Site for any bookings made after the relevant amendment. You understand and agree that if you use the Site after the date on which the Terms of Use have changed, the Company will treat your use as acceptance of the updated Terms of Use provided that any existing bookings will be governed by the Terms of Use and Conditions of Sale at the time that booking was made.
